Your agreement with Concordia when you use the website, assessment route, patient portal, checkout, communications, and non-clinical coordination services.

Please read these Terms & Conditions carefully before using the Concordia Men's Health website, intake route, patient portal, checkout, communications, or coordination services. These terms contain important rules about telehealth, prescriptions, recurring payments where offered, refunds, emergency limitations, arbitration where permitted, and class-action waiver where permitted.

Acceptance of these terms

These Terms & Conditions govern your access to and use of Concordia's website, assessment routes, account tools, patient portal links, communications, payment flows, administrative coordination, and related non-clinical services. By accessing the website, creating an account, clicking an acceptance box, submitting information, proceeding through checkout, or otherwise using the services, you confirm that you have read, understand, and agree to these terms.

Policies incorporated by reference

The Privacy Policy, Telehealth Consent, Refund Policy, payment and billing terms, SMS or messaging terms, provider notices, pharmacy notices, program disclaimers, and checkout disclosures made available to you are incorporated into these terms by reference.

Not for emergencies

The website, intake route, portal, and related services are not emergency medical services. If you are experiencing a medical emergency, including severe chest pain, difficulty breathing, signs of stroke, severe allergic reaction, suicidal thoughts, or any condition you believe may be life-threatening, call 911 or go to the nearest emergency department immediately. In a mental health crisis, call or text 988.

Definitions

Platform means the website, assessment route, patient portal links, account tools, communications, administrative coordination, and related services made available by Concordia. Provider Group means DrTelx or another independent licensed professional entity and its clinicians delivering clinical services where available. Pharmacy means a state-licensed pharmacy engaged to dispense medication prescribed by a provider. Medication means any prescription drug, compounded preparation, or related product coordinated through the services. Patient or you means the individual using the services or a legally authorized representative where permitted.

Eligibility

You must be at least 18 years old, physically located in the United States and in a jurisdiction where the provider group is licensed and care is permitted, legally able to enter a binding agreement, authorized to use any payment method provided, and able to provide accurate, current, and complete information. Service and medication availability may vary by state, pharmacy availability, provider licensure, medical eligibility, and applicable law.

Nature of the services

Concordia provides education, routing, administrative support, technology coordination, marketing, and non-clinical care coordination. Concordia is not a medical provider, pharmacy, insurer, emergency service, or prescription seller. Concordia does not practice medicine, nursing, pharmacy, or any other licensed healthcare profession, and does not diagnose, prescribe, compound, dispense, fulfill prescriptions, or interfere with provider or pharmacy judgment.

Your relationship with providers and pharmacies

Providers and pharmacies are independent of Concordia. Any clinician-patient relationship is established solely between you and the provider group once a provider accepts you for care. Clinical decisions are made by the provider in independent clinical judgment. Pharmacy decisions are made by the pharmacy in professional judgment and under applicable law.

Medical provider and pharmacy partners

Concordia is partnered with DrTelx, an independent telehealth medical group whose providers are licensed in the states where Concordia offers care. Concordia works exclusively with licensed U.S. pharmacies that meet rigorous regulatory and quality standards. Pharmacy partners include EPIQ Scripts, Foothills Compounding Pharmacy, and Emerald Compounding Pharmacy. Every pharmacy in the network is licensed in the states where it dispenses, accredited by the National Association of Boards of Pharmacy (NABP), board-certified, and LegitScript-approved. Prescriptions are filled and shipped by licensed U.S. pharmacies only when a valid prescription exists and where permitted by applicable state and federal law.

No prescription, medication, or outcome promise

Completing a website visit, eligibility flow, checkout step, or intake does not guarantee eligibility, approval, treatment, a prescription, any specific medication, medication access, pharmacy fulfillment, shipment timing, medical improvement, body change, appetite change, weight loss, or any other result.

Prescription products

Certain medications require a prescription issued by a licensed provider. You will not receive a prescription unless you complete the required clinical process and the provider determines that a prescription is medically appropriate. Medications dispensed through the services may not be returned for reuse or resale.

Compounded medication disclosure

Some provider-reviewed paths may involve compounded medications. Compounded medications are not FDA approved. The FDA does not review compounded drugs for safety, effectiveness, or quality. Concordia does not compound or manufacture medication. Any decision to use compounded medication is guided by the licensed provider's medical judgment and applicable law.

Not insurance and cash-pay status

Concordia is not an insurer, and the services are not an insurance product. Unless checkout or program terms state otherwise, services operate on a cash-pay basis and Concordia, the provider group, and pharmacies do not submit claims to commercial insurance, Medicare, Medicaid, TRICARE, or any other federal or state health benefit program on your behalf.

Telehealth consent

Clinical services delivered through the platform are telehealth services. Telehealth has benefits, risks, and limitations. You must review and accept the Telehealth Consent before receiving telehealth care.

Account registration and security

If account access is provided, you agree to provide accurate information, keep information current, safeguard credentials, and remain responsible for activity under your account. Notify support through the approved account or intake channel if you suspect unauthorized access.

License to use the platform

Subject to your compliance with these terms, Concordia grants you a limited, personal, non-transferable, revocable right to access and use the website and non-clinical services for your own lawful use. You may not copy, modify, reverse engineer, resell, or misuse the platform or its content except as permitted by law.

Prohibited conduct

You may not violate law, misrepresent your identity, residency, age, medical history, payment authorization, or eligibility information, upload unlawful or infringing content, attempt unauthorized access, scrape or extract data with automated tools, disrupt the platform, introduce malware, circumvent security features, resell prescription medication, or use the services in a way that endangers yourself or others.

User submissions and medical information

You retain ownership of information you submit. By submitting information, you authorize Concordia, providers, pharmacies, platform vendors, and service providers to host, store, process, transmit, and use that information as needed to provide services, comply with law, improve operations, protect safety, and enforce terms. You represent that information you provide is true, accurate, current, and complete.

Intellectual property

The website, brand assets, content, layout, design, text, graphics, and software are owned by Concordia or its licensors and protected by intellectual-property laws. Third-party trademarks belong to their respective owners.

Subscriptions, pricing, taxes, and payment

Where subscriptions, memberships, recurring billing, or one-time payments are offered, checkout disclosures control the price, billing interval, authorization, cancellation path, renewal terms, and taxes. Prices may change with required notice. You authorize the payment processor to authorize or charge your payment method for amounts due according to checkout terms.

Card authorization and provider approval

The card may be authorized at checkout. The actual charge occurs only after provider review, approval, and prescription where required. If the provider does not approve treatment, the card is not charged for that treatment path.

Cancellation and refunds

Cancellation, authorization release, renewal, medication, and refund rules are described in the Refund Policy and any checkout terms. Fees associated with services, provider review, pharmacy coordination, lab services, medication orders, support, and other services already rendered may be non-refundable except as stated or required by law.

Shipping and pharmacy fulfillment

If a provider issues a prescription and a pharmacy accepts it for fulfillment, shipping timing, carrier availability, cold-chain requirements, patient availability, address accuracy, weather, regulatory limits, and pharmacy operations may affect delivery. Shipment timing is not promised.

Third-party goods, services, and links

The website or communications may link to third-party websites, platforms, payment processors, providers, pharmacies, laboratories, or service providers. Their services are governed by their own terms and policies. Concordia is not responsible for third-party websites or services that it does not control.

Electronic communications

By using the services, you consent to receive electronic communications from Concordia, the provider group, pharmacies, platform vendors, and service providers. Electronic notices may satisfy legal requirements that communications be in writing where permitted by law. Standard message and data rates may apply.

Accuracy and service changes

Concordia makes reasonable efforts to keep information accurate but does not warrant that the website is error-free. Concordia may correct errors, change, suspend, or discontinue portions of the services where permitted by law.

Disclaimer of warranties

The website and non-clinical services are provided on an as-is and as-available basis to the fullest extent permitted by law. Concordia disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, timeliness, security, and error-free performance where permitted by law.

Limitation of liability

To the fullest extent permitted by law, Concordia and its owners, employees, contractors, vendors, and licensors are not liable for indirect, incidental, special, consequential, exemplary, punitive, loss-of-profit, loss-of-data, business-interruption, or similar damages arising from use of the website or services.

Indemnification and release

You agree to defend, indemnify, and hold harmless Concordia and its owners, employees, contractors, vendors, and licensors from claims, liabilities, losses, damages, and expenses arising from your breach of these terms, misuse of services, false submissions, violation of law, or violation of a third party's rights.

Copyright complaints

If you believe website content infringes your copyright, contact Concordia at support@concordiamenshealth.com with the work claimed to be infringed, the material at issue, your contact information, a statement of good-faith belief, and a statement made under penalty of perjury that the information is accurate and you are authorized to act.

Disputes, arbitration, and class-action waiver

Where permitted by law and presented in checkout, account, or program terms, disputes may be subject to binding individual arbitration and a waiver of class, collective, or representative actions. You may still have rights that cannot be waived under applicable law.

Governing law and venue

These terms are governed by applicable federal law and the laws applicable to Concordia Men’s Health, LLC, without regard to conflict-of-law principles. Venue and forum rules apply only to the extent permitted by law and any non-waivable consumer or patient rights.

Force majeure

Concordia will not be liable for delay or failure caused by events beyond reasonable control, including natural disasters, carrier disruption, supply constraints, pharmacy interruption, provider availability, labor issues, technical outages, governmental action, or changes in law.

Geographic restrictions

Services are available only to individuals located in the United States and in states or jurisdictions where the provider group is licensed and where care is permitted by applicable law.

Changes to these terms

These terms may be updated as operations, law, provider relationships, pharmacy relationships, platform tooling, or service availability changes. Continued use after an update means you accept the updated terms where permitted by law.
